The ruling stems from the case of David Heater, a sole proprietor and sole employee of a one-man general contracting business who fractured his neck in a 2015 fall from a ladder during roof repairs. Erie Insurance denied the claim on two grounds: that Heater was not injured during the course of employment, and that he failed to notify the insurer within 120 days as required by Section 311. The case took 11 years to reach the state’s highest court.

The Supreme Court found that “employer” under Section 311 means the business entity, not the insurance carrier. Because a sole proprietor is simultaneously the employer and the employee, notice of injury is effectively instantaneous. Chief Justice Debra Todd wrote that the Commonwealth Court had incorrectly interpreted the statute, and that any perceived deficiency in the law must be addressed by the legislature, not the courts.

The ruling remands Heater’s disability benefits claim back to the Workers’ Compensation Bureau for final determination.
